MINUTE entry before the Honorable Sharon Johnson Coleman: The Court grants Plaintiff's motion to file under seal [9]. However, upon further review of Plaintiff's complaint, the Court is not satisfied that Plaintiff has established that the Court has personal jurisdiction over Defendant. Plaintiff alleges that Defendant operates an online storefront that ships to Illinois customers, but Plaintiff hasn't offered any actual proof of Illinois sales or products shipped to Illinois. Instead, the complaint relies only on "information and belief" to state that Illinois sales have happened. That is insufficient to establish personal jurisdiction. For cases such as this-Schedule A cases involving foreign defendants selling goods online-courts in this district have found that "Creating a website, providing that Illinois residents could purchase products through the website, selling products through third-party websites, sending written confirmation of the sales and including Illinois shipping addresses, and shipping the product to Illinois residents are circumstances sufficient to find a business purposely avails itself of the privilege of conducting business in Illinois." Manchester United Football Club Ltd. v. Partnerships & Unincorporated Associations Identified on Schedule A, No. 24 CV 5692, 2024 WL 5202272, at *3 (N.D. Ill. Dec. 23, 2024) (Chang, J.) (citing NBA Props., Inc. v. HANWJH, 46 F.4th 614, 624 (7th Cir. 2022)). Jurisdiction can often be established in cases such as this by showing concrete evidence of a sale to an Illinois customer and a shipment to an Illinois address. See Emoji Co. GmbH v. The Individuals, Corps., Ltd. Liab. Cos., P'ships, and Unincorporated Ass'ns Identified on Schedule A, No. 23-cv-1112, (Dkt. 54, at 1) (N.D. Ill. Sept. 16, 2023) (Kness, J.) (finding no personal jurisdiction where defendants did not ship any infringing products); Tee Turtle LLC v. Individuals, Corps., Ltd. Liab. Companies, Partnerships, & Unincorporated Associations Identified on Schedule A to Complaint, No. 25 CV 02910, 2025 WL 2880218, at *3 (N.D. Ill. Oct. 9, 2025) (Coleman, J.) (similar); see also Manchester United Football Club, 2025 WL 2880218, at *5 (finding personal jurisdiction, despite a lack of shipped goods, where defendant accepted payment for infringing product with intent to ship to forum state, but later issued a refund). Because the Court is not satisfied that it has jurisdiction over Defendant, the Court dismisses Plaintiff's complaint [1] without prejudice. Plaintiff may file an amended complaint within 21 days if it is able to supply sufficient evidence that personal jurisdiction exists. If Plaintiff chooses to submit an amended complaint, Plaintiff is also directed to update the caption to replace Defendant "John Doe" with Plaintiff's best understanding at this time of Defendant's name. Consideration of Plaintiff's motions for a temporary restraining order [6] and for electronic service [8] are stayed pending resolution of the jurisdiction issue. Mailed notice. |
