2024-05-06 MAILED to plaintiff(s) counsel Lanham Mediation Program materials
2024-05-06 MINUTE entry before the Honorable John J. Tharp, Jr: The plaintiff is directed to file, under seal, a chart identifying which screenshots in the Exhibit 2 to the Kloetzky Decl. correspond to which defendants on the schedule A and which trademark(s) each defendant is accused of infringing through the products depicted in the screenshots. It is due 5/24/24. Mailed notice

2024-05-23 MINUTE entry before the Honorable John J. Tharp, Jr:Plaintiffs' motion for TRO 11 is denied without prejudice. The plaintiffs' screenshot evidence in the sealed Ex. 2 fail to demonstrate a likelihood of success as to several defendants in the sealed schedule A. For instance, defendant no. 128 is clearly not using the asserted word mark as an indicator of the source of its goods. Similarly, defendant no. 133 is simply referring to the general concept that is relevant to the plaintiff's word mark. The plaintiff may file a renewed motion for TRO (and, as necessary, an amended complaint or schedule A) by 6/14/24 after conducting a more rigorous review of its allegations and list of defendants. Mailed notice

2024-07-16 LETTER from Tibor Levai dated 7/16/2024. (Received via pro se email on 7/16/2024)
2024-07-18 MINUTE entry before the Honorable John J. Tharp, Jr: The Court has received a letter from defendant no. 47 61. The Court construes it as an objection to the pending motion preliminary injunction. The plaintiff may reply in support of its motion for preliminary injunction as to this defendant by 7/25/24. Mailed notice
2024-07-22 MINUTE entry before the Honorable John J. Tharp, Jr: Upon further inspection of the screenshot evidence of alleged infringements, it appears that several screenshots were taken as early as 2022 and 23 (see, e.g., ECF No. 32), but the plaintiff did not seek preliminary injunctive relief until May 2024 11. The plaintiff is ordered to show cause by 7/25/24 why the TRO 42 should not be dissolved and why the pending motions for preliminary injunction 48 55 should not be denied on the basis that the plaintiff is unlikely to have suffered irreparable harm due to its delay in bringing these claims and because there is no evidence that any of the defendants were actively infringing at the time of the initiation of this lawsuit. The plaintiff and its counsel are also required to certify by 7/25/24 the efforts they took to determine whether the defendant marketplaces were actively infringing at the time the plaintiff brought the lawsuit and sought a TRO, and to certify that the plaintiff has not used the particular screenshot evidence asserted in this case in any other proceeding asserting an online counterfeiting claim against the defendants in this case. The pending motions for preliminary injunction 48 55 will remain under advisement, and the deadline for any objections to them is extended to 7/30/24. Mailed notice
