MINUTE entry before the Honorable Manish S. Shah: The motions to seal, for a TRO, discovery, and electronic service of process [5][11][13] are granted in part, denied in part. No appearance on the motions is necessary. Plaintiff's counsel is advised, however, that counsel cannot notice a motion for telephonic appearance without advance permission from the court. All motions are to be noticed for in-person presentment. The motion to seal is denied. The public has a right to know who is using the federal courts, and plaintiff's fear of the movement of assets does not outweigh the public interest. An ex parte TRO is extraordinary relief and plaintiff has not provided sufficient evidence of likelihood of success to justify ex parte relief. Adversarial presentation is necessary to evaluate plaintiff's claims. But because plaintiff does not have sufficient identifying information for defendants, plaintiff has good cause to conduct early discovery and alternative service of process is necessary to notify defendants of this action.
