Jenkins: The Court is not prepared to grant the request for a temporary restraining order based on the information contained in the template Plaintiff filed [see [11]], so the motion for a TRO [12] is denied without prejudice to renewal. The majority of the dates listed in the 'last date collected column' are from 2023 or the first half of 2024. The most recent dates are from September and early October 2024. For some but not all of the 2023 dates, the chart says, "Product still available as of January 22, 2025" and that this statement is an indication of whether defendant is still offering Plaintiff's copyrighted works for sale. But the Court cannot verify this information. Indeed, many of the included links in the submission do not take the court to active webpages that appear to still offer the offending material for sale. In short, the information provided does not persuade the Court that without prompt relief, Plaintiff will suffer "immediate and irreparable injury" as required under FRCP 65(b)(1)(A) for a TRO to issue. Plaintiff is free to file an amended template or amended complaint which narrows the number of Defendants listed in Schedule A, but the Court will not grant a TRO without a very recent showing of alleged infringement which would support immediate relief. Any renewed motion for a TRO must be accompanied by a revised Schedule A template. Plaintiff must take some action to move the case forward by January 30, 2025, otherwise the Court will consider dismissal without prejudice. Mailed notice.
