16 2024-06-28 CERTIFICATE of Service by Plaintiff Benjamin Robert Haggar regarding text entry, 15
17 2024-07-09 MINUTE entry before the Honorable Joan B. Gottschall: The deadline for non-party TEMU, LLC ("TEMU"), to request a hearing on, or file a written response to, plaintiff's motion for leave to conduct expedited discovery has come and gone, and nothing has been received. Upon consideration of the certificate of service 16 filed 6/28/2024, plaintiff's motion 12 for leave to conduct expedited discovery is granted. Paragraph 2(c) of the proposed order emailed to the court on 6/28/2024 requires defendant to certify steps it has taken to comply with paragraphs 1(a)-(c). Paragraph 2(c) has been removed because the cross-referenced paragraphs 1(a)-(c) require TEMU to produce certain discovery material, but they do not require defendant to do anything. Paragraph 2(c) has been deleted. The proposed language in paragraph 3 authorizing plaintiff to serve the summons and complaint by electronic means has also been removed because plaintiff does not argue in his motion 12 or in his supporting memorandum of law 13 that electronic service is appropriate, and nothing in the record indicates that plaintiff has conducted a reasonably diligent inquiry to determine defendant's mailing address, which is required before the court can authorize service of the summons and complaint by electronic means. See generally Luxottica Grp. S.p.A. v. Partnerships & Unincorporated Associations Identified on Schedule "A", 391 F. Supp. 3d 816, 821-28 (N.D. Ill. 2019). Enter order. A status report on the progress of expedited discovery is due by and including 8/6/2024. Mailed notice
