The court construes plaintiff's notices of voluntary dismissal as a motion for leave to amend the complaint to drop the defendants named in its notices of voluntary dismissal and grants plaintiff's motion. See Fed. R. Civ. P. 15(a). However, plaintiff seeks to dismiss five defendants [51] without prejudice and with leave to reinstate within 180 business days if payment is not received. While these five defendants have been dropped from the amended complaint, plaintiff has not asked the court to enter a partial judgment against them or to make the findings required by Fed. R. Civ. P. 54(b) needed to enter a partial judgment. Accordingly, the five defendants listed in doc. no. [51] must be included in any final judgment, and the final judgment must provide that these defendants are dismissed without prejudice and that the dismissal of these defendants will convert to a dismissal with prejudice on a date certain.
