While a court is authorized to enter a final judgment of default against a party who has failed to plead in response to a complaint, a "'defendant's default does not in itself warrant the court entering a default judgment.'" Chanel, Inc. v. Replicachanelbag, 362 F. Supp. 3d 1256, 1259 (S.D. Fla. 2019) (quoting DIRECTV, Inc. v. Huynh, 318 F. Supp. 2d 1122, 1127 (M.D. Ala. 2004)). Granting a motion for default judgment is within the trial court's discretion. See id. (citation omitted). Because a defendant is not held to admit facts not well pleaded or admit conclusions of law, the Court must first determine whether there is a sufficient basis in the pleading for the judgment to be entered. See id. (citations omitted); see also Buchanan v. Bowman, 820 F.2d 359, 361 (11th Cir. 1987) ("[L]iability is well-pled in the complaint[ ] and is therefore established by the entry of default[.]" (alterations added; citation omitted)). Here, Plaintiff's proposed order accompanying its Motion does not provide any analysis or authority for entry of the requested judgment, and does not break down a basis for the damages sought by Plaintiff. See [51-2]. A motion for final default judgment demands more: the plaintiff must describe the legal standard and facts supporting the claims and damages, such that the Court can determine whether judgment is warranted. Here, the proposed order merely rubber stamps the requested relief. Given these deficiencies, the Court is unable to find that default judgment is appropriate. As an example of the kind of thorough analysis needed to obtain a default judgment before this Court in Schedule "A" intellectual property infringement cases, Plaintiff is directed to review this Court's Order Granting Default Judgment in a similar case. See Spike Cable Networks Inc. v. The Individuals, Business Entities, and Unincorporated Associations Identified on Schedule A, No. 1:25-cv-22171-RAR, at ECF No. 50. Accordingly, Plaintiff's 51 Motion is DENIED without prejudice and with leave to refile. Pursuant to S.D. Fla. CM/ECF Administrative Procedure 3(I)(6), Plaintiff shall submit a proposed order accompanying its refiled Motion that adequately lays out the legal standards and provides legal analysis and authority for entry of the requested relief to ruiz@flsd.uscourts.gov in Word format and file it on the active docket on or before October 13, 2025.
