On November 10, 2025, the Court ordered Plaintiffs to show cause as to whether joinder of the Plaintiffs in this trademark infringement action is proper under Federal Rule of Civil Procedure 20(a). [ECF No. 4]. The Court, having reviewed Plaintiffs' Response and the record, finds that joinder here is appropriate and Plaintiffs may proceed with this action as filed. See Vanover v. NCO Fin. Servs., Inc., 857 F.3d 833, 839 (11th Cir. 2017) ("Joinder is 'strongly encouraged' and the rules are construed generously 'toward entertaining the broadest possible scope of action consistent with fairness to the parties.'" [+] 10 2025-11-25 Plaintiff's MOTION to Seal per Local Rule 5.4 by Apple Corps Limited, Subafilms Limited.
[+] 13 2025-12-01 PAPERLESS ORDER denying 10 Plaintiffs' Motion to File Under Seal ("Motion"). As stated in the Court's Omnibus Order Regarding Schedule "A" Causes of Action ("Omnibus Order"), motions to file documents under seal or to proceed anonymously or pseudonymously in intellectual property rights cases are disfavored by the Court, [ECF No. 7] at 4-5. See Landmark Commc'ns, Inc. v. Virginia, 435 U.S. 829, 839 (1978) ("The operations of the courts. are matters of utmost public concern."); Chicago Trib. Co. v. Bridgestone/Firestone, Inc., 263 F.3d 1304, 1311 (11th Cir. 2001) ("The common-law right of access to judicial proceedings, an essential component of our system of justice, is instrumental in securing the integrity of the process."); Doe v. Frank, 951 F.2d 320, 323 (11th Cir. 1992) ("It is the exceptional case in which a plaintiff may proceed under a fictitious name."). Accordingly, such motions shall be denied absent a showing of exceptional circumstances. Brown v. Advantage Eng'g, Inc., 960 F.2d 1013, 1016 (11th Cir. 1992). Here, Plaintiffs' Motion fails to articulate exceptional circumstances necessitating the temporary sealing of portions of the court file. Plaintiffs' Motion to File Under Seal, [ECF No. 10], is thus DENIED. Plaintiffs have also filed under seal an Ex Parte Motion for Entry of Temporary Restraining Order, [ECF No. 11] and an Ex Parte Motion for Order Authorizing Alternate Service of Process, [ECF No. 12]. As the Court has denied Plaintiffs' Motion to Seal, all filings must now appear on the public docket. In lieu of automatically unsealing all filings on the docket and revealing information Plaintiffs may not wish to make public, the Court DENIES Plaintiffs' Motions, [ECF Nos. 11 and 12], without prejudice and grants Plaintiffs leave to refile these motions and the accompanying exhibits on the public docket on or before December 8, 2025, in compliance with the Court's Omnibus Order. Signed by Judge Rodolfo A. Ruiz, II on 12/1/2025.
